ideCAD software is developed and operated by ideYAPI Anonim Şirketi, operating under the brand name “ideCAD” (“ideCAD”, “we”, “our”, or “us”).

The Software includes architectural design, building information modeling (BIM), structural analysis, structural design, detailing, and related engineering computation tools.

The Software is intended for use by qualified design professionals, including architects and engineers.

2. Professional Responsibility

The Software is a professional computational tool and does not replace professional judgment.

All decisions relating to:

• Architectural layouts and spatial planning
• Building modeling and coordination
• Structural modeling assumptions
• Load definitions and combinations
• Seismic parameters
• Material properties
• Interpretation of analysis results
• Code compliance determinations
• Final design approval

remain solely and exclusively the responsibility of the licensed professional using the Software.

Users must independently review, validate, and verify all outputs before relying on them for construction, fabrication, permitting, regulatory submission, or certification.

3. Seismic and High-Risk Applications

Structural and architectural design in seismic or other high-risk regions involves inherent uncertainties and real-world variables beyond the control of the Software.

The Software does not guarantee:

• Structural safety
• Seismic performance
• Regulatory approval
• Building code acceptance
• Project performance outcomes

For projects involving public safety, high-rise buildings, hospitals, bridges, critical infrastructure, or other safety-critical applications, independent professional verification is required.

Ultimate responsibility for life-safety and regulatory compliance rests with the licensed design professional and project stakeholders.

4. No Engineering or Architectural Certification

Use of the Software does not constitute:

• Engineering certification
• Architectural approval
• Regulatory authorization
• Governmental approval

Only properly licensed professionals may issue certifications or approvals.

5. No Guarantee of Regulatory Compliance

Although the Software may implement computational procedures based on published codes and standards, interpretation and application of those codes may vary by jurisdiction.

Users are solely responsible for ensuring compliance with applicable local laws, regulations, and standards.

6. Data and Backup Responsibility

Users are solely responsible for maintaining independent backups of all project files, models, drawings, and engineering data.

Unless expressly agreed in writing, ideCAD does not guarantee permanent storage or recovery of user data.

7. Limitation of Liability

To the maximum extent permitted by applicable law, ideCAD shall not be liable for:

• Structural failure
• Seismic performance issues
• Design errors
• Regulatory rejection
• Construction defects
• Project delay
• Loss of profits
• Loss of data
• Business interruption
• Any indirect, incidental, special, or consequential damages

Liability limitations are further governed by the applicable Software License Agreement.

Nothing in this Disclaimer excludes or limits liability for fraud, willful misconduct, or any liability that cannot legally be excluded.

8. Assumption of Professional Risk

By using the Software, the user acknowledges that architectural and structural design inherently involves professional risk.

The user assumes full responsibility for the professional application of the Software in any project.

9. Relationship to License Agreement

This Disclaimer supplements and forms part of the Software License Agreement.

In the event of any conflict, the Software License Agreement shall prevail.
